Service Level Agreement (SLA) & General Terms and Conditions of Shubeik Digital Ecosystem

Owner & Developer: TheCust for Information Technology, in partnership with Shubeik Public Services.

Preamble:

This agreement constitutes a comprehensive and legally binding contract governing all digital and technical interactions between the "User" (hereinafter referred to as the Subscriber or Client) and the "Digital Ecosystem," which includes the informational website shubeik.qa and the comprehensive business management portal shubeikos.com. Your use of any services signifies an explicit acknowledgment and unconditional acceptance of all terms and conditions set forth below.

Article 1: Definitions & Technical Terminology

  • The Ecosystem: The unified digital entity combining the public interface (shubeik.qa) and the cloud-based platform (shubeikos.com).
  • Shubeik OS: The comprehensive operating and integration system, cloud-based, specifically developed for enterprise management.
  • Cloud Services (SaaS): Software provided as a service over the internet, requiring no local software installation.
  • Sensitive Data: Includes, but is not limited to (payroll data, employee records, bank account details, and geographical locations).

Article 2: Eligibility for Use & Subscription

  • The user affirms full legal capacity to enter into contracts or possesses the official authorization to represent the subscribing company or entity.
  • Subscribing entities are committed to providing accurate and up-to-date information upon registration on the shubeikos.com portal.
  • The Ecosystem management reserves the right to suspend any account if misleading or inaccurate data is identified.

Article 3: Shubeik OS Integration System

  • Shubeik OS is a closed and secured system. Subscribers are granted access under a temporary "License to Use" linked to the subscription period.
  • The portal includes exclusive automation tools for Wage Protection System (WPS) files. The Ecosystem is committed to periodically updating algorithms to comply with banking regulations in Qatar.
  • All Artificial Intelligence (AI Tools) within the portal are assistive tools to enhance work quality and are subject to human review by the Subscriber before final approval.

Article 4: Intellectual Property & Exclusive Rights

  • All trademarks, source codes, User Interfaces (UI), and User Experiences (UX) are the absolute intellectual property of TheCust for Information Technology.

    • The following actions are strictly prohibited under penalty of law:

  • Attempting to breach or conduct unauthorized penetration testing on the system.
  • Using automated means (Scrapers/Bots) to extract data from the platform.
  • Reverse engineering the system or attempting to replicate the features of Shubeik OS.

Article 5: Cybersecurity & Data Confidentiality

  • The Ecosystem is committed to providing Multi-layer Security to safeguard subscriber data.
  • Sensitive data is encrypted using international (AES-256) protocols.
  • The Ecosystem performs periodic backups for shubeikos.com data to ensure no data loss in cases of Force Majeure.
  • The Subscriber is solely responsible for maintaining the confidentiality of login credentials for their employees' accounts on the portal.

Article 6: Financial Policy & Subscriptions

  • Service fees are determined based on the subscription plans outlined in the official price list.
  • The Ecosystem reserves the right to adjust fees with prior notice; adjustments do not apply to active subscriptions until renewal.
  • In the event of subscription expiry without renewal, the management reserves the right to restrict access to stored data on shubeikos.com after a designated grace period.

Article 7: Liability Limits & Recruitment Section Regulations

  • Shubeik Recruitment Initiative: The user acknowledges that the jobs section on (shubeik.qa) is a "Free Initiative" aimed at supporting social responsibility by facilitating the link between job seekers and companies in Qatar.
  • No Fees Charged: The Shubeik Ecosystem and "TheCust" management affirm they are NOT a recruitment agency and do not charge any fees or financial amounts from job seekers for employment or mediation.
  • Content Disclaimer: The Ecosystem acts as a display platform only; we bear no responsibility for the accuracy of CVs or the credibility of job advertisements posted by third-party companies. Both parties (the company and the seeker) are responsible for verifying information and complying with Qatar Labor Law.
  • Fraud Warning: The Ecosystem warns all users against dealing with any entity claiming to represent us and requesting money for job placement. Please report such activities immediately to info@shubeik.qa.

Article 8: Technical Liability Limits & Public Services

  • Shubeik OS Portal: Our responsibility is limited to the accurate technical processing of outputs based on Subscriber inputs. Any error resulting from incorrect data entry is the full responsibility of the Subscribing Company.
  • External Services & Verification: When requesting integration or verification services with global platforms (Google, Meta, etc.), our role is limited to technical mediation according to the evolving policies of those platforms.
  • Government Decisions: All PRO services and consultations are assistive; final decisions are always subject to the authority of the official government entities in the state.
  • Technical Downtime: We are not liable for any temporary service interruption resulting from periodic maintenance, global server infrastructure updates, or Force Majeure circumstances.

Article 9: Termination of Service

  • Subscribers have the right to cancel their subscription at any time, subject to the financial terms regarding the cancellation period and renewal rights.
  • The Ecosystem reserves the right to terminate any subscription immediately in case of a breach of acceptable use policies or any attempt to harm the technical integrity of the system.

Article 10: Governing Law & Dispute Resolution

  • This agreement shall be governed by and construed in accordance with the laws of the State of Qatar.
  • In the event of a dispute, an amicable settlement shall be sought first. If no agreement is reached, the Doha Courts shall have exclusive jurisdiction over the dispute.

Article 11: Amendments & Updates

The Ecosystem management reserves the right to amend this agreement at any time to keep pace with technical and legal developments. The version published on shubeik.qa is considered the official and binding version.
